Terms of Service

The plain-language summaries ("In short") help you read these Terms. They are part of the Terms, not a replacement for them. If a summary and the full text seem to say different things, the reading that is most favourable to you applies.
1. Who we are and what these Terms cover
In short: Komnu is run by a Dutch company. These Terms apply to the Komnu apps and to the komnu.app website. Our Privacy Policy explains what we do with your personal data.
1.1. Komnu is operated by Komnu, an eenmanszaak (sole proprietorship) registered in the Netherlands with the Chamber of Commerce (KvK) under number 42175589 and VAT (btw) number NL005558432B92, with its address at Oder 20, 2491 DC Den Haag, the Netherlands ("Komnu", "we", "us"). You can reach us at support@komnu.app.
1.2. These Terms of Service ("Terms") apply to:
- the Komnu mobile apps for Android and iOS (the "App"); and
- the public website at komnu.app, including its game, city and sport pages, the map, the shared-game pages at komnu.app/g/… and the data the website serves (the "Website").
Together we call these the "Service".
1.3. The Website is read-only, except for the account deletion page. You cannot create an account, pay or post anything on it. You can sign in at komnu.app/account/delete only to request the deletion of your Komnu account, follow or cancel that request and download your data (see section 8.6). If you only visit the Website, the parts of these Terms about accounts, Pro and your content do not apply to you; sections 1, 3, 11, 14, 15, 16, 19, 20 and 23 to 27 do.
1.4. Our Privacy Policy explains how we collect and use personal data, including your rights under the GDPR. It is a separate document, not part of this contract.
2. Accepting these Terms and the minimum age
In short: You must be 18 or older to use the App. By creating an account you accept these Terms. If you don't agree, please don't use Komnu.
2.1. You accept these Terms when you create a Komnu account. During sign-up the App asks you to confirm that you are 18 or older and that you accept these Terms, with a link to them, and we record which version of these Terms you accepted (identified by its "Last updated" date) and when. By visiting the Website you agree to the parts of these Terms that apply to visitors.
2.2. You must be at least 18 years old to create an account or use the App. The App asks for your date of birth when you sign up and does not let you continue if you are under 18. If your App Store or Google Play account is a US account, the App also asks the store for your age range (section 25.2). If you are under 18, do not use the App. If we have reason to believe an account belongs to someone under 18, for example after a report, we will review it and delete the account.
2.3. Age check in the United Kingdom and Australia (added for lawyer review). If the App identifies you as being in the United Kingdom or Australia, for example from the country of your App Store or Google Play account or of your home area, you must pass an age check to keep using the App. A face age estimate is used, with an ID document if the estimate is under 18 or close to 18. You can try the check once a day. Until you pass, your account stays locked and the App shows only the age check. If you do not finish the check, we do not block or delete your account. If the face estimate shows you are under 18, we ask you for an ID document. We block your account only if an ID document shows you are under 18. We delete a blocked account 30 days after the block. How the check works and the data it uses are described in our Privacy Policy.
2.4. You may use the Service only for your own personal, non-commercial use, unless we have agreed otherwise in writing (see section 5.3).
3. What Komnu is, and what it is not
In short: Komnu helps people find and organise pickup sport games. We are not the organiser of any game, we don't run venues, we don't take payments for games, and we don't check the people you meet.
3.1. Komnu is a coordination tool. It lets players host pickup sport games ("games"), find games on a map, join a game or its waitlist, chat with the other players, check in at the venue, and send direct messages.
3.2. Komnu is not a party to any game. The person who creates a game (the "host") organises it. The host and the players arrange the game among themselves. We do not organise, supervise, referee, coach, insure or run any game, and we do not employ, represent or act as agent for any host or player.
3.3. We do not check people or places. We do not verify the identity, age, skills, fitness, background, qualifications or reliability of hosts or players, and we do not inspect, approve or check venues, their safety or whether the host is allowed to use them. A check-in count, badge or "played together" line on a profile only reflects past check-ins recorded by the App. It is not a rating, a reference or a guarantee.
3.4. We do not process payments for games. A price shown on a game is the host's estimate of each player's share of costs. Any payment is made directly between people, outside Komnu (see section 7).
3.5. The App is free to use. Some extra features are available with a paid Komnu Pro subscription (see section 9).
4. Sport, health and safety: you take part at your own risk
In short: Sport is physical and people get hurt. Only play if you are fit to, check the venue yourself, and meet people sensibly. You can leave any game at any time, and you can report or block anyone. In an emergency, call 112. Players answer to each other under the law, so liability insurance is a good idea.
4.1. Physical activity carries risk. Taking part in sport can lead to injury, illness and, in rare cases, death, and to damage to or loss of your belongings. Weather, surfaces, equipment and other players all add risk. You decide whether to take part, and you do so at your own risk, as far as the law allows. Section 20 explains what we remain responsible for.
4.2. Your health is your responsibility. Komnu does not give medical, fitness or training advice. Before you play, make sure you are fit and healthy enough for the activity and its level. If you have a medical condition, are pregnant, are recovering from an injury or are unsure, ask a doctor first. Stop if you feel unwell.
4.3. No supervision. No one from Komnu is present at games. Hosts are ordinary users, not instructors, lifeguards or first-aiders. Bring what you need, such as water, suitable clothing and protective equipment.
4.4. Check the venue yourself. A game's location is a pin set by the host. It may be inaccurate, the venue may be closed, unsafe, private or need a booking or permit, and conditions may have changed. Look at the place before you play and do not enter places you are not allowed to be.
4.5. Meeting people you don't know. Games bring together people who may not know each other. Please:
- meet in public places, and tell someone you trust where you are going;
- arrange your own travel and keep your belongings with you;
- do not share more personal information than you need to;
- trust your instincts: you can leave any game at any time, without penalty;
- report anyone who makes you feel unsafe, using Report profile in the App or by emailing support@komnu.app, and block them if you wish. A block hides you from each other's games and stops messages between you.
4.6. Emergencies. Komnu is not an emergency service and does not monitor games. In an emergency, call 112 (or your local emergency number). Report crimes to the police.
4.7. Other players' conduct. We are not responsible for what other users do or fail to do, at a game or anywhere else, including a host who cancels or a player who does not show up. Section 20 sets out the limits of this.
4.8. Liability between users and insurance. If you injure another user or damage their belongings, at a game or elsewhere, you are liable to them under the general law, and they are liable to you in the same way. These Terms do not change that. We recommend that you have personal liability insurance (in the Netherlands, an aansprakelijkheidsverzekering particulieren, or AVP) and health insurance that covers sport injuries.
5. Hosting a game
In short: If you host, you are the organiser. Describe the game honestly, pick a place you are allowed to use, follow the rules that apply there, and don't run a business through Komnu unless we've agreed to it.
5.1. When you create a game, you are its organiser and you are responsible for it. You promise that:
- the information you give is accurate and kept up to date, including the sport, date and time, location, format, skill level, number of players, the price estimate and the description;
- you are allowed to use the venue at that time, and you have any booking, permission, permit or licence the venue or the law requires;
- the game, the venue and any route you attach are lawful and reasonably safe for the activity described, as far as you can tell;
- you will cancel the game in the App, as early as you can, if it cannot go ahead;
- you will treat players fairly and lawfully, and use kick and block for genuine reasons, not to discriminate unlawfully against anyone.
5.2. What others can see. A game's details (sport, time, location pin and address, format, skill level, price estimate, player count and description) are shown in the App to people who can see the game, and the Website publishes open games publicly, including the venue location, without the name of the host or any player. When you create an open game, the App tells you that it will be listed on komnu.app. A route (GPX course) you attach, including its start and finish, is visible to everyone who can see the game. Do not put personal information in a game's title, description or location that you do not want to be public.
5.3. No commercial use without our permission. Komnu is for social, non-profit games. Unless we have agreed in writing, you may not use Komnu to run a business, such as paid coaching, classes, camps, leagues, tournaments with prize money, or events organised to make a profit, and you may not advertise or sell products or services through it. Sharing real costs (for example a court booking) is allowed.
5.4. Weekly series. If you set up a weekly series, each new game it publishes is a game you host, and this section applies to every one of them.
6. Joining and attending games
In short: Join only games you plan to attend, and leave in the App if your plans change so someone else gets your place. Hosts can remove or block players.
6.1. Joining a game or its waitlist tells the host and other players that you intend to come. If you cannot make it, leave the game in the App as soon as you know. You are always free to leave a game before it ends.
6.2. Waitlists. When a full game has a waitlist and a place opens up, the App may move the next person on the waitlist into the game automatically, without asking them again. By joining a waitlist you agree to this. Pro members are placed ahead of free members on a waitlist; within each group the order is first come, first served.
6.3. Hosts manage their games. A host can remove ("kick") players before a game starts and can block players from their future games. Komnu does not review or overturn these decisions, unless they break these Terms or the law.
6.4. Check-ins. A check-in records that your device was at the venue at game time (see section 13). Check in only when you are actually at the game.
6.5. No-shows. Repeatedly joining games you do not attend, or holding places you do not intend to use, is unfair to other players. Players can report it, and serious or repeated abuse may lead to measures under section 12.
7. Prices and payments between players
In short: Komnu doesn't handle money for games. Any price is the host's estimate, and you settle it between yourselves. Refunds and disputes about game costs are between you and the host.
7.1. A price on a game is an estimate by the host of each player's share of costs, in the currency the host chose. It is not an offer or a price set by Komnu, and it may differ from what you are finally asked to pay.
7.2. Komnu does not process, hold or guarantee any payment for games, and we are not a party to any agreement between players about costs. Any payment, for example in cash or by a payment request, is made directly between users, outside Komnu.
7.3. Refunds between users are not our responsibility. If a game is cancelled, changed or does not happen, any refund or dispute about money is between you and the person you paid. We cannot reverse or refund such payments.
7.4. Consumer law between users. Hosts are usually private individuals, not businesses. When you deal with a private individual, EU consumer protection law (such as the right of withdrawal) generally does not apply to that relationship. If a host acts as a business with our permission under section 5.3, the host is responsible for complying with the consumer law that applies to it. Komnu does not check whether a host is a business.
8. Your account
In short: One account per person, with true information. Keep your sign-in safe. You can download your data at any time. You can ask to delete your account in the App or on the Website: your account is locked straight away and deleted for good 7 days later, unless you sign in and cancel before then. While it is locked, you can still leave games you joined or cancel games you host.
8.1. Signing up. You can create an account with a Google account, with an Apple account (Sign in with Apple, on iPhone and iPad), or with an email address and password. For an email account you must confirm your address with a code we email to you. If you sign in with Apple and choose to hide your email address, Apple gives us a private relay address that forwards our emails to you.
8.2. One account, one real person. You may have only one account. It must belong to a real person, and you must not create an account for someone else or pretend to be someone else. The information you give, including your date of birth and gender, must be accurate. The gender you choose at sign-up cannot be changed later in the App; if it is wrong, contact us.
8.3. Your username. Your public handle is your username plus a four-digit tag (for example sam#0420). It must not be offensive, misleading or infringe anyone's rights. We may change or reset a username that breaks these Terms.
8.4. Security. Keep your password and your devices secure, and do not share your account. You are responsible for what happens through your account unless it was used without your permission and you were not careless. Tell us at support@komnu.app straight away if you think someone has accessed your account.
8.5. Downloading your data. You can download a copy of your data in the App (Settings) as a file. Our Privacy Policy describes what it contains and your other data rights.
8.6. Deleting your account. You can ask us to delete your account at any time, in the App (Settings) or at komnu.app/account/delete after signing in there. Your account is then locked straight away and permanently deleted 7 days later. Once it is deleted, this cannot be undone. We email you when you ask for deletion. While the account is locked you can only check its status, download your data, repeat the deletion request, cancel the deletion, leave games you joined or cancel games you host; until it is deleted, your profile and the games you host stay visible to other users. To keep your account, sign in, in the App or on that page, and choose Cancel deletion before the 7 days end; signing in alone does not cancel the deletion. We email you to confirm the cancellation. If you cannot sign in, you can ask us by email to delete your account, as explained on that page; once we have checked that the request comes from you, we delete the account without the 7-day wait, and at the latest within one month. When your account is deleted:
- games you are hosting that have not finished are cancelled and their players are told;
- your places in other games and waitlists are released;
- your profile picture, photos, alert zones, feedback board posts and votes, and your record of past games are deleted;
- every direct message conversation you took part in is deleted, with its photos, voice clips and videos, for both people in it;
- messages you sent in a game's match chat stay visible to its players, shown as from "Deleted user", until that chat is deleted 7 days after the game ends;
- a Pro subscription is not cancelled automatically. Cancel it in the App Store or Google Play first (see section 9).
Some information may be kept for a limited time where the law allows or requires it, as the Privacy Policy explains.
8.7. Inactive accounts. If you do not open the App for two years, we may delete your account. We will warn you by email, and by push notification where we can, at least 30 days before we do. This does not apply while you have an active Pro subscription.
9. Komnu Pro
In short: Pro is a subscription you buy through the App Store or Google Play, for one of the billing periods offered there (weekly, monthly, three-monthly or annual). It renews automatically until you cancel it in the store. Refunds follow the store's rules. If Pro ends, your extra features pause but your data stays.
9.1. What Pro is. Komnu Pro is an optional paid subscription that adds features to the App, as described in the App at the time of purchase. At the date of these Terms, Pro includes: starting direct messages with any player, hosting up to three games at once (instead of one), up to three weekly series that publish games automatically, priority on waitlists, unlimited alert zones (instead of one), choosing your own four-digit tag, video messages, seeing who viewed your profile, and a Pro badge and highlight. Pro does not guarantee a place in any game or any other outcome.
9.2. Buying through the stores. You buy Pro through the Apple App Store or Google Play. The store processes the payment, under its own terms, and its terms decide how you pay. We use a service provider (RevenueCat) to check with the store whether your subscription is active. We never see your card or bank details.
9.3. The price of Pro and when it can change. You pay the price the App Store or Google Play shows you when you subscribe or renew. The store shows it in your local currency, including VAT where it applies, and charges it on its own billing dates. A Pro subscription is linked to your account; you cannot pass it on to someone else.
We may raise or lower the price of Pro, but only for one or more of these reasons, and only in proportion to them:
- a change in VAT or another tax or levy charged on Pro;
- a change in the commission the App Store or Google Play takes from us, or in their price tiers or currency conversion;
- a change in what it costs us to provide Pro, such as servers, storage, map data, message delivery and the subscription service we use;
- inflation, measured by the consumer price index of Statistics Netherlands (CBS);
- new Pro features that add significantly to what Pro offers.
Before a higher price applies to you, we tell you at least 30 days in advance, by email or, if we cannot email you, in the App. The notice says what the new price is, why it is changing and from which renewal it applies. Your store may tell you too and, where its rules or the law require, ask you to agree. A new price never applies to a period you have already paid for: it starts at your first renewal after the notice period. If you do not want to pay it, cancel before that renewal (section 9.5).
9.4. Automatic renewal. Pro renews automatically at the end of each billing period, and you are charged again, until you cancel. Cancelling stops the next renewal. You keep Pro until the end of the period you have already paid for. Pro has no free trial.
9.5. Cancelling. You can cancel at any time in your store account: on iPhone in Settings > your name > Subscriptions, and on Android in Google Play > Payments & subscriptions > Subscriptions. The App's subscription screen links to these. Deleting the App or your Komnu account does not cancel the subscription.
9.6. Refunds. Refunds for Pro are handled by the store under its refund policy (Apple: reportaproblem.apple.com; Google Play: the Google Play Help Center). We cannot issue refunds for store purchases ourselves. This does not limit your statutory rights.
9.7. Your 14-day right of withdrawal. If you are a consumer living in the European Economic Area, the law lets you change your mind about Pro: you have 14 days from the day you take out a Pro subscription, or move to a different Pro plan, to withdraw from it. Because you buy Pro from the App Store or Google Play, you withdraw through your account with that store and follow its process (App Store: reportaproblem.apple.com; Google Play: the Google Play Help Center). If you get stuck, email support@komnu.app and we will help you. Apart from this right, the store refunds in section 9.6 and any refund these Terms or the law give you, Pro payments are not refunded.
9.8. When Pro ends. If your subscription ends (because you cancelled, a payment failed or a refund was given), the free limits apply again. Nothing is deleted: your weekly series pause and publish no new games, alert zones beyond your oldest one pause, you can host only one game at a time again (games already published stay), and your chosen tag is replaced by a random free tag. If you subscribe again, paused series and alert zones resume.
10. Your content
In short: What you post stays yours. You give us permission to store and show it so Komnu works. Only post things you have the right to post, and remember others can see it.
10.1. What counts as your content. "Your content" is anything you add to the Service: your username, profile picture, profile photos and captions, bio, games and their descriptions, routes (GPX files), match chat and direct messages, photos, voice messages and video messages you send, feedback board posts and votes, Community posts, comments, likes, photos and videos, reports, and anything else you submit.
10.2. You keep ownership. You own your content. We do not claim ownership of it.
10.3. The permission you give us. You give Komnu a non-exclusive, worldwide, royalty-free licence to host, store, copy, process, adapt (for example resize, re-encode or reformat), translate and show your content, and to pass it to our service providers, only as far as needed to run, secure, improve and promote the Service, including showing games on the Website and in shared links. This licence ends when your content is deleted from the Service, except: (a) for content that stays visible to others under section 8.6 (such as match chat messages you sent, until that chat is deleted), (b) for content we must keep by law or to deal with a report or legal claim, and (c) for backups, which are overwritten in the ordinary course. We will not sell your content.
10.4. Who can see your content. Different content is visible to different people: for example a game to everyone who can see it in the App and publicly on the Website, a match chat to the host and players of that game, a direct message to the people in that conversation, and your profile picture and photos only to people who share a game or an accepted conversation with you. The App describes these rules where they apply, and the Privacy Policy explains them in detail.
10.5. Your promises. You promise that you have the rights needed to post your content and to give us the licence above, and that your content and its use under these Terms do not break the law or anyone's rights (such as copyright, portrait rights or privacy). Do not post photos or recordings of other people without their permission where the law requires it.
10.6. Feedback. If you send us ideas or suggestions (for example on the feedback board), we may use them freely, without paying you. A feedback post you mark as anonymous is shown without your name to other users; we still know that you wrote it.
10.7. Community posts (added for lawyer review). Posts, comments, likes, photos and videos in the Community tab are visible, with your username and profile picture, to signed-in members of that country's community, to Komnu Pro users and to Komnu moderators (you always see your own), and you choose that by posting. The licence in section 10.3 covers displaying them to those users in the App for as long as they stay on the Service; it ends as described there when you delete them or your account. Other users may not copy, repost or reuse them outside Komnu without your permission. You can delete your own posts and comments at any time. Commenting needs the same access as reading, so it is open to signed-in members of that country's community and to Komnu Pro users; posting, liking and joining other countries' communities follow the rules of your plan (section 9). Community content is never part of the public Website. [VERIFY: counsel to confirm the licence wording for user-visible content]
11. Community rules: what is not allowed
In short: Be decent, be honest and don't misuse Komnu or its data. Use what you learn about other people on Komnu only for the game, and play fair at games. Breaking these rules can lead to content being removed or your account being restricted or closed.
11.1. When using the Service, you must not:
- post or send anything illegal, including content that is threatening, harassing, hateful or discriminatory, sexually explicit, violent, defamatory, or that infringes intellectual property or privacy rights;
- harass, bully, stalk, threaten, intimidate or abuse anyone, online or at a game;
- send spam, scams, chain messages or unsolicited advertising, or use Komnu to sell things;
- create fake games, fake profiles or multiple accounts, impersonate any person or organisation, or misrepresent your age, identity or gender;
- use Komnu if you are under 18, or help anyone under 18 to use it;
- repeatedly join games you do not intend to attend, hold places to block others, or check in when you are not at the venue;
- host games at venues you are not allowed to use, or for activities that are illegal or unreasonably dangerous;
- use Komnu commercially without our written permission (see section 5.3);
- share other people's personal information without their consent, including contact details, location, photos or messages from private conversations;
- scrape, crawl, harvest or copy data from the App, the Website or our interfaces (APIs) by automated means, or build a database or competing service from our data, except crawling and indexing of the Website's public pages as our robots.txt allows (see section 14.3);
- access or use our APIs other than through the App or the Website, or try to get around rate limits, blocks, privacy settings or other technical limits;
- probe, test or break our security, access accounts or data that are not yours, or interfere with the Service, for example by uploading malware or overloading our systems;
- copy, modify, decompile, reverse-engineer or create derivative works of the App, except as far as the law expressly allows;
- misuse the report function, for example by sending reports you know are false.
11.2. Using what you see on Komnu. Komnu shows you things about other people, such as their username, profile, photos, messages and the games they join. Use this only to organise, join and play games and to keep in touch about them. Do not collect or ask for other users' health or injury details, or their passport, identity card, citizen service (BSN) or other identification numbers, and do not keep or pass on other users' details for any other purpose. If you host a game and you move its players to a group chat outside Komnu (for example on WhatsApp) or collect their phone numbers or other contact details, you decide what happens with that data and you are responsible for it under the law, including the GDPR where it applies. Komnu has no control over it.
11.3. At games. When you play in a game you found through Komnu:
- do not use violence or force beyond the normal physical contact that the sport's rules allow;
- do not play under the influence of alcohol or drugs;
- do not film or photograph other players without their consent;
- follow the venue's rules and the instructions of its staff.
11.4. In the Community (added for lawyer review). All the rules in section 11.1 apply to posts, comments and photos or videos in the Community tab, in particular:
- you must be 18 or older, and so must anyone shown in your photos or videos;
- nothing illegal, and in particular no child sexual abuse material, terrorist content, threats, incitement to hatred or violence, or content that sexualises or exploits anyone;
- no spam: no repeated or copied posts, no advertising or selling, no scams, and no links in the first 24 hours of a new account;
- choose the right country, channel and topic label; only Komnu may post in Announcements;
- do not post other people's personal information, or photos of them without their consent;
- respect the posting limits; do not try to get around them.
11.5. If you see something that breaks these rules, please report it (see section 12).
12. Moderation, reporting and complaints
In short: We use an automatic filter for offensive words, and people at Komnu review reports. If we take action against your content or account, we tell you why and you can challenge it. You can report illegal content in the App or by email.
12.1. Automatic filtering. We automatically filter text that other people will read, including chat and direct messages, bios, game titles and descriptions, and feedback posts. The filter masks words it identifies as offensive or profane before the text is shown to others. It does not delete the message and does not restrict your account. Usernames that the filter identifies as offensive cannot be chosen. The filter can make mistakes in both directions; if it masks something wrongly, tell us.
For the Community (added for lawyer review), we also use automated checks: before a post or comment is saved, a filter refuses severe slurs and repeated text; after it is saved, an AI service (Cloudflare Workers AI) scores the text and photos. A high score can hide the item until a person has looked at it, and a medium score puts it in a review queue. Videos are not checked automatically. The automated checks can be wrong; if your content was hidden or removed wrongly, appeal under section 12.10.
12.2. Human review. Reports are reviewed by people at Komnu. We do not use automated systems to decide on reports or to restrict accounts. Automated checks may hide Community content temporarily (section 12.1), but only a person at Komnu removes it for good.
12.3. How to report. You can report in the App:
- a user, with Report profile on their profile (you can block them at the same time);
- a message in a match chat or a direct message, including a photo, voice clip or video, with Report on the message;
- a game or its route, with Report game or Report route on the game;
- a feedback board post, with Report on the post;
- a Community post or comment, with Report on it.
You can also report anything, including any content you believe is illegal, by email to support@komnu.app, without an account. See Report illegal content for the notice details.
This includes complaints that content on Komnu infringes your copyright, trademark or other intellectual property right. Tell us which right is affected and who holds it, where the content is, and how we can reach you; if you act for the rights holder, say so.
A report of illegal content should include: (a) why you believe the content is illegal; (b) where the content is (for example the username, the game, the date and time, or the web address); (c) your name and email address, unless the report concerns child sexual abuse material; and (d) a statement that you believe in good faith that the information in your report is accurate and complete. We confirm receipt of email reports. We treat every report diligently, objectively and without arbitrary delay, and we tell you our decision: in the App for reports made in the App, and by email for reports made by email. If we become aware of information that gives rise to a suspicion that a criminal offence involving a threat to the life or safety of a person has taken place, is taking place or is likely to take place, we will promptly inform the police or judicial authorities of the EU country or countries concerned and give them all relevant information we have.
12.4. What we may do. If content or conduct breaks the law or these Terms, we may, proportionately to how serious, how frequent and how intentional the breach is and taking into account the rights and interests of everyone involved:
- remove or hide content, or make it less visible;
- remove a profile picture or photos, or reset a username;
- give a warning;
- restrict features (such as hosting or messaging) for a period;
- suspend or close an account.
12.5. Telling you why. If we remove your content or restrict your account, we will tell you, at the latest when the measure takes effect, in the App and by email to your sign-in address where we have one, what we did, the facts and the rule (law or clause of these Terms) it is based on, whether we used automated means, and how you can challenge it, unless the law prevents us or the content is deceptive high-volume commercial content.
12.6. Complaints. If you disagree with a decision we took on a report (as the reporter or as the person concerned), you can complain by email to support@komnu.app within six months of the decision. We review complaints free of charge, with people involved, and reply with our decision and reasons without undue delay. If we were wrong, we will reverse the measure.
12.7. Out-of-court dispute settlement. If you live in the EU and our complaint process does not resolve your dispute about a moderation decision, you may also turn to an out-of-court dispute settlement body certified under the Digital Services Act. Using such a body is voluntary, and you can always go to court instead.
12.8. Points of contact. Our single point of contact for users, and for authorities of the EU Member States, the European Commission and the European Board for Digital Services, is support@komnu.app. You can write to us in English or Dutch.
12.9. What we do not moderate. We do not settle disputes between players about who attended, game results, play or money. Hosts manage their own games (section 6.3).
12.10. Community content: notices, removal and appeals (added for lawyer review). Anyone can tell us about Community content they think is illegal or breaks these Terms, with Report in the App or by email as in section 12.3, and we handle it as described there. If we hide or remove a Community post, comment, photo or video, we tell you in the App (and by email where we have your address), at the latest when it takes effect, with a statement of reasons: what we decided, the facts, the law or clause it is based on, whether an automated check (the AI scores in section 12.1) was used to detect it or to decide, and how to appeal. You still see your own hidden or removed items, with the reason. To appeal, or for any question about a Community decision, write to support@komnu.app within six months; a person reviews it as in section 12.6, and we restore the content if we were wrong. The out-of-court option in section 12.7 also applies.
13. Location features
In short: Location features use your device's GPS and map data, which are not always accurate. A failed or missing check-in is not proof of anything.
13.1. The App uses your device's location only when you ask it to: when you tap Check in at a game, and when you tap Use my location to centre a map or place a pin. Before it reads your precise location for the first time, the App asks for your permission on its own screen, separate from these Terms, and only then does your phone ask for its location permission. You can withdraw that permission at any time in the App's Settings; pins you have already saved stay. The App does not track you in the background. You can use the rest of the App without sharing your location, by placing pins on the map yourself; only check-in needs it.
13.2. Check-ins work only within a set distance of the venue pin, at game time, and when your device reports its location precisely enough. Device location, GPS signal and the pin set by the host can all be inaccurate, so a check-in may fail even though you were there, and a check-in count does not prove that someone attended or behaved well.
13.3. Alert zones notify you about new games around a place and within a radius you choose. Alerts depend on push notifications and may be late or not arrive at all. Do not rely on them.
13.4. Maps, addresses, distances, travel information and links that open your phone's maps app come from third-party map data (see section 16) and may be inaccurate or out of date.
14. The website and public game data
In short: Anyone can browse open games on komnu.app without an account. Search engines and AI services may crawl the public pages, but copying our data in bulk or mining it, including to train AI, needs our permission.
14.1. The Website shows public information about open games (such as sport, time, location, price estimate and how many places are left), cities and sports, and a map. It never shows the names of hosts or players. Joining a game happens only in the App.
14.2. Shared links to a game (komnu.app/g/…) show a simplified public card of the game with only its city or area.
14.3. You may view, link to and share pages of the Website for personal, non-commercial purposes. Search engines and other crawlers, including those of AI services, may crawl and index the Website's public pages as our robots.txt allows. The selection and arrangement of the game data on the Service is protected, including by database rights. We expressly reserve our rights to text and data mining of the Service, including for training AI models, under Article 4(3) of Directive (EU) 2019/790 and Article 15o of the Dutch Copyright Act, so text and data mining needs our prior written permission. We also state this reservation in machine-readable form, in the file /.well-known/tdmrep.json and in the tdm-reservation header of every page of the Website. Section 11.1(10) applies.
15. Our rights and your licence to use the App
In short: Komnu's app, website, name and design belong to us. You may use the App on your own devices for personal use.
15.1. The Service, including its software, design, texts, graphics, logos and the Komnu name, belongs to Komnu or our licensors and is protected by intellectual property laws. Open-source and map data credits are listed on our Licenses page; their own licences apply to those parts.
15.2. Subject to these Terms, we give you a personal, non-exclusive, non-transferable, revocable licence to install and use the App on devices you own or control, for your own non-commercial use. You may not use our name, logo or trademarks without our written permission.
16. Third-party services
In short: Komnu works with services run by other companies, such as the app stores, Google sign-in and map providers. Their terms apply to your use of them.
16.1. The Service relies on, or links to, services provided by third parties, including:
- Apple (App Store, iOS, and Sign in with Apple) and Google (Google Play, Android, and Google sign-in);
- RevenueCat, which checks the status of Pro subscriptions bought in the stores;
- OpenFreeMap map tiles and OpenStreetMap map data (© OpenStreetMap contributors), shown with MapLibre;
- your phone's own maps app, when you open a venue in it.
16.2. Your use of those services is governed by their own terms and privacy policies. We are not responsible for third-party services, their availability or their content, except where the law makes us responsible. Our Privacy Policy lists the service providers that process personal data for us.
17. Additional terms for the iOS App
In short: If you use Komnu on an iPhone or iPad, Apple requires a few extra terms. Apple isn't responsible for Komnu; we are.
17.1. If you downloaded the App from the Apple App Store, the following also applies:
- These Terms are between you and Komnu only, not Apple. Komnu, not Apple, is solely responsible for the App and its content.
- Your licence to use the App is limited to use on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the App may also be used by other accounts associated with you through Family Sharing or volume purchasing where available.
- Komnu, not Apple, is solely responsible for any maintenance and support of the App. Apple has no obligation to provide any maintenance or support.
- Komnu is responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are Komnu's responsibility, as far as these Terms and the law make them so.
- Komnu, not Apple, is responsible for addressing any claims by you or a third party relating to the App or your possession and use of it, including product liability claims, claims that the App fails to conform to any legal or regulatory requirement, and claims under consumer protection, privacy or similar legislation.
- If a third party claims that the App or your possession and use of it infringes that party's intellectual property rights, Komnu, not Apple, is solely responsible for the investigation, defence, settlement and discharge of that claim.
- You confirm that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- Questions, complaints or claims about the App can be sent to Komnu at the contact details in section 27.
- You must comply with any applicable third-party terms when using the App.
- Apple and its subsidiaries are third-party beneficiaries of these Terms, and once you accept these Terms, Apple has the right (and will be deemed to have accepted the right) to enforce them against you as a third-party beneficiary.
17.2. If these Terms conflict with Apple's Usage Rules on the points above, Apple's rules apply for the iOS App.
18. Additional terms for the Android App
In short: If you got Komnu from Google Play, Google's terms also apply to the store side of things.
18.1. If you downloaded the App from Google Play, the Google Play Terms of Service and Google Play's payment and refund policies also apply to your download and to any Pro purchase. Google is not responsible for the App.
19. Availability and changes to the Service
In short: We work hard to keep Komnu running, but we can't promise it will always be available or work perfectly. We may change features; if a change takes away something you paid for, you can cancel.
19.1. We try to keep the Service available and working well, but the Service is provided as it is and as available. It may be interrupted for maintenance, updates or reasons beyond our control, and it may contain errors. You need a compatible device and an internet connection, at your own cost.
19.2. We may change, add or remove features. If a change materially reduces what you get from a Pro subscription you have already paid for, we will tell you in advance and you can cancel; where the law gives you a right to a refund or price reduction, you keep it.
19.3. We may stop offering the Service, or the Service in a certain country. We will give you reasonable notice, normally at least 30 days, so you can download your data, except where that is not possible for legal, security or technical reasons.
20. Our liability
In short: We are responsible for what the law says we cannot exclude, such as harm we cause deliberately or through gross negligence, and death or personal injury caused by our fault. We are not responsible for what other users do, or for games we don't organise.
20.1. What we never exclude. Nothing in these Terms limits or excludes our liability:
- for death or personal injury caused by an act or omission of Komnu or the people we are responsible for;
- for damage caused by our intent (opzet) or deliberate recklessness or gross negligence (bewuste roekeloosheid or grove schuld), or that of our management;
- for fraud; or
- for anything else that cannot be limited or excluded under the law that applies to you, including your statutory rights as a consumer, such as the rights you have if digital content or a digital service does not conform to the contract.
20.2. Within those limits:
- We are not liable for loss or damage caused by other users or third parties, including hosts, players, venue owners and third-party service providers, or that arises from a game, a venue or a meeting arranged through the Service, because we do not organise, supervise or control these (see sections 3 and 4).
- We are not liable for loss of profit, revenue, business or opportunity. The Service is for personal use.
- We are not liable for loss that was not reasonably foreseeable when you accepted these Terms.
- For any other loss caused by an attributable failure of Komnu, our total liability to you is limited to the fees you paid to Komnu in the 12 months before the event that caused the loss, or EUR 100, whichever is higher.
20.3. Events beyond our control. We are not responsible for failing to perform an obligation because of circumstances beyond our reasonable control (force majeure), such as natural disasters, extreme weather, pandemics, war, terrorism, government action, failures of public networks or power, or outages at our hosting, mail or app-store providers. We will try to limit the effects and resume as soon as possible.
20.4. Hosting of content. We store and show content provided by users. Under the Digital Services Act we are not liable for that content unless we know it is illegal and do not act quickly to remove it or disable access to it.
20.5. Claims to us. To make a claim, please tell us as soon as reasonably possible after you discover the problem, so we can try to solve it, by emailing support@komnu.app. This does not shorten any legal limitation period.
21. Your responsibility to us
In short: If you break these Terms or the law through Komnu and that causes us damage, you are responsible for it, as the law provides.
21.1. If you breach these Terms or the law in connection with the Service, and that breach is attributable to you, you are liable for the resulting damage under the law, including reasonable costs we incur because a third party (for example another user or a venue) makes a claim against us based on your content or conduct. This does not apply to the extent the damage was caused by us.
22. Suspension and termination
In short: You can leave whenever you want. We only restrict or close accounts for good reasons, we tell you why, and you can challenge our decision.
22.1. By you. You can stop using the Service at any time and delete your account in the App or on the Website (see section 8.6). Remember to cancel any Pro subscription in the store.
22.2. By us. We may restrict, suspend or close your account, or refuse access to the Service, if:
- you seriously or repeatedly break these Terms or the law, for example by harassing others, posting illegal content or using a fake profile;
- you are under 18;
- we need to in order to protect the safety of users or others, or the security of the Service;
- a court or authority orders us to; or
- your account has been inactive as described in section 8.7.
22.3. Fair process. Our measures are proportionate and based on facts. Before we suspend or close an account, we will warn you and give you an opportunity to respond, unless the breach is so serious, or the risk to others so urgent, that this cannot reasonably be expected, or the law prevents it. We will tell you our reasons as described in section 12.5, and you can complain as described in sections 12.6 and 12.7. While your account is suspended, the App shows until when, and you can still read your notifications, download your data and delete your account. We will suspend accounts that frequently provide manifestly illegal content, for a reasonable period and after a prior warning. We may also, for a reasonable period and after a prior warning, stop handling reports and complaints from someone who frequently sends manifestly unfounded ones.
22.4. Effects. When your account is closed, your right to use the App ends, and your data is handled as described in section 8.6 and in the Privacy Policy. If we close your account because of a serious breach, we may for a limited period prevent you from creating a new account, as described in the Privacy Policy. If we suspend or close your account because you breached these Terms, you are not entitled to a refund of Pro fees already paid. If we close your account without a breach by you while you have a paid Pro period left, we will refund the unused part where the store allows, or otherwise directly. This does not affect your statutory rights as a consumer.
22.5. Sections that continue. Sections 7, 10.3 (as far as content remains visible), 10.6, 11.1(10) and (13), 11.2, 20, 21, 24, 25 and 26 continue to apply after your account ends.
23. Changes to these Terms
In short: If we change these Terms in a way that matters, we tell you at least 30 days in advance. If you don't agree, you can delete your account before the change takes effect.
23.1. We may change these Terms for valid reasons, such as changes to the Service, to the law or to how we run Komnu, or to make them clearer.
23.2. For changes that matter to you, we will notify you at least 30 days before they take effect, in the App and/or by email, and we will explain what is changing. If you do not agree, you can delete your account before the changes take effect; if you have a Pro subscription and the change is to your disadvantage, you can also cancel it and, where the law requires, receive a pro-rata refund. If you keep using the App after the changes take effect, the new Terms apply to you.
23.3. We may make changes that are purely editorial, or that are required by law with a shorter deadline, without advance notice.
23.4. The date at the top shows when these Terms last changed. Earlier versions are available on request.
24. Governing law and disputes
In short: Dutch law applies, but wherever you live, as a consumer you keep the protections your own country's law gives you and you can usually go to court at home. Let's try to solve problems together first. There is no arbitration.
24.1. Talk to us first. If you have a complaint, please email support@komnu.app. We aim to reply within 14 days. Most problems can be solved this way.
24.2. Governing law. These Terms and any dispute about them are governed by Dutch law. If you are a consumer, wherever you live, this does not take away the protection given to you by the mandatory rules of the law of the country where you live.
24.3. Courts. You can bring a dispute before the court in The Hague (Rechtbank Den Haag). That court is available to you but not the only one: if you are a consumer, you may also bring proceedings in the courts of the country where you live, wherever the law of that country allows it. We will bring proceedings against a consumer only in the courts of the country where that consumer lives.
24.4. No class action waiver or forced arbitration. Nothing in these Terms requires you to use arbitration, wherever you live, or prevents you from joining a collective action that the law allows.
24.5. The European Commission's online dispute resolution (ODR) platform has been discontinued. For moderation decisions, see section 12.7.
25. Country-specific terms
In short: Some countries give you extra rights or ask us to tell you extra things. This section lists them. If you live in one of these countries, its part applies to you on top of the rest of these Terms.
25.1. How this section works. Sections 1 to 24, 26 and 27 apply wherever you live. This section adds what the law of a particular country requires, or what we want to make clear for people who live there. If a part of this section gives you more protection than another section, that part applies. If your country is not listed, this section changes nothing for you.
25.2. United States.
- Automatic renewal. Pro is a subscription that renews automatically (section 9.4). Before you subscribe, the App Store or Google Play shows you the price, the billing period and that the subscription continues until you cancel. At the start of each new billing period, the store charges you the price it showed you, until you cancel. You can cancel at any time, without contacting us: on iPhone in Settings > your name > Subscriptions, and on Android in Google Play > Payments & subscriptions > Subscriptions (section 9.5). Cancelling stops the next renewal; you keep Pro until the end of the period you have paid for. The store confirms your subscription, with its renewal terms and how to cancel, after you buy. We tell you before a higher price applies (section 9.3). This paragraph gives the information that California's automatic renewal law (Business and Professions Code section 17600 and following) and similar laws of other states require.
- Age check through your store. If your App Store or Google Play account is a US account, the App asks the store for the age range on your account during sign-up, and after that at most once every 12 months. The App asks only for US store accounts. We keep only the time of the last check, never the age range or the store's answer. If the store reports that you are under 18, your account is blocked from the App, as it would be if you entered a date of birth under 18 (section 2.2). If the store does not give an answer, for example because you choose not to share it, the date of birth you entered applies.
- Disputes. Section 24 applies to you as it stands: you never have to arbitrate, and nothing in these Terms stops you from joining a collective action that your state's law allows.
25.3. Switzerland.
- Swiss consumer law. If you are a consumer living in Switzerland, these Terms remain governed by Dutch law, but Swiss law decides any question about our contract with you where Swiss private international law requires it for consumer contracts (Article 120 of the Federal Act on Private International Law). The mandatory protections of Swiss consumer law therefore always apply to you.
- Your home courts. You may bring proceedings in the courts at your place of residence in Switzerland, or in The Hague. We can bring proceedings against you only in the courts at your place of residence in Switzerland (Article 114 of the same Act).
25.4. Quebec (Canada).
- Consumer protection. If you are a consumer living in Quebec, the mandatory rules of Quebec's Consumer Protection Act (CQLR, c. P-40.1) apply to you and cannot be waived by these Terms. Nothing in these Terms limits them. If a provision of these Terms gives you less than that Act requires, the Act applies.
- No arbitration, no class action waiver. These Terms contain no arbitration clause and no waiver of class actions, and we do not ask you to agree to either. Section 24.4 applies to you as it stands.
- Your home courts. If you are a consumer, you may bring proceedings in the courts of Quebec where you have your domicile or residence. The Civil Code of Québec (art. 3149) gives the Quebec courts jurisdiction over an action based on a consumer contract when the consumer is domiciled or resident in Quebec, and a consumer's waiver of that jurisdiction cannot be set up against the consumer. [VERIFY: Quebec counsel to confirm]
- French. A French version of these Terms is available, and if you live in Quebec you may rely on it. This respects section 55 of the Charter of the French Language (CQLR, c. C-11), which requires a contract of adhesion to be given to you in French before you are bound, unless you expressly choose another language.
25.5. Adding countries. When the law of another country requires something these Terms do not already cover, we add a numbered part to this section. Each part names the country, says what it adds and applies only to people who live there. Adding a part is a change to these Terms under section 23. Until your country has its own part, these Terms apply to you as they stand, together with the mandatory law of the country where you live (section 24.2).
26. General
In short: The usual legal small print, written to be fair.
26.1. Entire agreement. These Terms (together with any terms shown when you buy Pro) are the whole agreement between you and Komnu about the Service.
26.2. Severability. If any part of these Terms is invalid or unenforceable, the rest remains in effect, and the invalid part is replaced by a valid one that comes as close as possible to its purpose, as far as the law allows in your favour.
26.3. No waiver. If we do not enforce a right straight away, we do not give it up.
26.4. Transfer. We may transfer our rights and obligations under these Terms to another company, for example in a merger or sale of the business, if this does not reduce your rights; we will tell you in advance and you can delete your account if you do not agree. You may not transfer your account or your rights under these Terms.
26.5. No partnership. Nothing in these Terms creates a partnership, employment or agency relationship between you and Komnu.
26.6. Electronic communication. You agree that we may contact you electronically, in the App, by push notification or by email, and that such messages meet any requirement for written communication, as far as the law allows.
26.7. Language. These Terms are written in English. If we publish them in other languages, all language versions have equal standing. Where versions differ, the reading that is most favourable to you applies.
26.8. Headings are for convenience only.
